KVKK Aydınlatma Metni

1. Veri sorumlusu

6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) uyarınca kişisel verileriniz, veri sorumlusu sıfatıyla Book Grup Organizasyon Hizmetleri Sanayi ve Ticaret Limited Şirketi, Limonluk Mah. 2453 Sokak, Ofis Çözümleri No: 3/C, Yenişehir / Mersin (“Platform”) tarafından, istanbulvitotransfer.com sitesi üzerinden aşağıda açıklanan kapsamda işlenmektedir. E-posta: info@bookgrup.com

Rezervasyon talebiniz iletildikten sonra bu verileri kendi adına kullanan araç sahibi, bu kullanım bakımından ayrı bir veri sorumlusudur.

2. İşlenen kişisel veriler

• Kimlik: ad soyad.
• İletişim: telefon numarası, e-posta adresi.
• Rezervasyon talebi (yolcular): güzergâh, tarih ve saat, yolcu sayısı, mesajınız, dil tercihi, talebin durumu.
• Üyelik (araç sahipleri): parola özeti (hash), dil tercihi, e-posta doğrulama ve onay zamanları; araç bilgileri (model, yıl, donanım, kapasite, konum, fiyatlar, fotoğraflar) ve isteğe bağlı plaka.
• İşlem güvenliği: IP adresi, erişim tarih ve saati, tarayıcı bilgisi, oturum ve tek kullanımlık bağlantı kayıtları, istek sayıları.
• İlan istatistikleri: ilan sayfasının gün bazında toplam görüntülenme sayısı. Bu sayı kişisel veri içermez; ziyaretçinin IP adresi ya da kimliği kaydedilmez.
• Yönetim kayıtları: ilan onay, ret, yayından kaldırma ve hesap askıya alma işlemleri ile gerekçeleri.

3. İşleme amaçları

• Rezervasyon taleplerinin ilgili araç sahibine iletilmesi ve tarafların iletişime geçmesi.
• Üyelik hesabının açılması ve yönetilmesi; e-posta doğrulama ve parola sıfırlama.
• İlanların yayınlanması, kontrol edilmesi ve ilan bilgilerinin (kısaltılmış ad, telefon, konum, diller, araç bilgileri, fiyatlar, fotoğraflar) herkese açık olarak gösterilmesi.
• İşlemsel bildirimlerin gönderilmesi (doğrulama, parola, ilan onayı/reddi, talep bildirimi).
• Sitenin güvenliğinin sağlanması, kötüye kullanımın ve otomatik saldırıların önlenmesi.
• Sorularınızın yanıtlanması ve hukuki yükümlülüklerin yerine getirilmesi.

4. Hukuki sebepler (KVKK m.5)

• Rezervasyon talebi, üyelik ve ilan işlemleri: bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması (m.5/2-c).
• Güvenlik ve yönetim kayıtları: temel hak ve özgürlüklerinize zarar vermemek kaydıyla veri sorumlusunun meşru menfaati (m.5/2-f).
• Yasal taleplerin karşılanması ve kayıtların tutulması: hukuki yükümlülüğün yerine getirilmesi (m.5/2-ç).
• Bunların dışında kalan hâllerde açık rızanız (m.5/1).

5. Aktarım

• Araç sahipleri: rezervasyon talebiniz (ad, telefon, e-posta ve talep ayrıntıları) seçtiğiniz ilanın sahibine üye paneli ve e-posta ile iletilir.
• Yolcular: araç sahibinin kısaltılmış adı ve telefonu, talebi bırakan yolcuya iletilir; ilan bilgileri zaten herkese açıktır.
• Hizmet sağlayıcılar (yurt dışı): barındırma, veritabanı ve fotoğraf depolama için Cloudflare; işlemsel e-posta gönderimi için Resend; yazı tipleri için Google Fonts. Sunucular yurt dışındadır; yurt dışına aktarım KVKK m.9’da öngörülen şartlara (yeterli koruma bulunan ülkeler, uygun güvenceler ya da m.9/6’daki istisnalar) uygun olarak yapılır.
• Yetkili kurumlar: yasal bir talep olması hâlinde mahkemeler ve kamu kurumları.

6. Toplama yöntemi

Verileriniz sitedeki formlar (rezervasyon talebi, kayıt, ilan verme, hesap ayarları) aracılığıyla doğrudan sunucumuza; iletişim ve teklif formları aracılığıyla e-posta yoluyla; ayrıca sunucu ve oturum kayıtları aracılığıyla elektronik ortamda, otomatik veya kısmen otomatik yollarla toplanır.

7. Saklama süreleri

Rezervasyon talepleri en fazla 12 ay; üyelik verileri hesap açık kaldığı sürece (silme hâlinde anonimleştirilir); oturum kayıtları en fazla 30 gün; e-posta gönderim kayıtları 90 gün; ilan görüntülenme sayaçları 400 gün; e-posta yazışmaları en fazla 2 yıl. Ayrıntılar Gizlilik Politikası’nda yer alır.

8. Haklarınız (KVKK m.11)

• Kişisel verilerinizin işlenip işlenmediğini öğrenme; işlenmişse bilgi talep etme.
• İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme.
• Yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme.
• Eksik veya yanlış işlenmişse düzeltilmesini; şartları oluşmuşsa silinmesini veya yok edilmesini isteme.
• Düzeltme, silme ve yok etme işlemlerinin aktarılan üçüncü kişilere bildirilmesini isteme.
• Münhasıran otomatik sistemlerle analiz sonucu aleyhinize bir sonuç çıkmasına itiraz etme.
• Kanuna aykırı işleme nedeniyle zarara uğramanız hâlinde zararın giderilmesini talep etme.

9. Başvuru

Haklarınıza ilişkin taleplerinizi Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ’e uygun olarak Limonluk Mah. 2453 Sokak, Ofis Çözümleri No: 3/C, Yenişehir / Mersin adresine yazılı olarak ya da info@bookgrup.com adresine e-posta ile iletebilirsiniz. Üyeler ad, telefon ve dil bilgilerini hesap ayarlarından düzeltebilir ve hesaplarını silebilir. Başvurular en geç 30 gün içinde sonuçlandırılır.

1. Data controller

Under the Turkish Personal Data Protection Law No. 6698 (“KVKK”), your personal data are processed as described below through the site istanbulvitotransfer.com by Book Grup Organizasyon Hizmetleri Sanayi ve Ticaret Limited Şirketi, Limonluk Mah. 2453 Sokak, Ofis Çözümleri No: 3/C, Yenişehir / Mersin (the “Platform”) acting as data controller. Email: info@bookgrup.com

Once your booking request has been passed on, the vehicle owner who uses these data on their own behalf is a separate data controller in respect of that use.

2. Personal data processed

• Identity: full name.
• Contact: phone number, email address.
• Booking request (passengers): route, date and time, number of passengers, your message, language preference, status of the request.
• Membership (vehicle owners): password digest (hash), language preference, email verification and consent times; vehicle details (model, year, trim, capacity, location, prices, photos) and the optional plate number.
• Transaction security: IP address, access date and time, browser information, session and single-use link records, request counts.
• Listing statistics: the total number of views of a listing page per day. This figure contains no personal data; the visitor’s IP address or identity is not recorded.
• Administrative records: listing approval, rejection, removal and account suspension actions, together with their reasons.

3. Purposes of processing

• Passing booking requests to the relevant vehicle owner and enabling the parties to get in touch.
• Opening and managing the membership account; email verification and password reset.
• Publishing and reviewing listings and displaying listing information (short name, phone, location, languages, vehicle details, prices, photos) publicly.
• Sending transactional notifications (verification, password, listing approval/rejection, request notification).
• Ensuring the security of the Site and preventing misuse and automated attacks.
• Answering your questions and fulfilling legal obligations.

4. Legal bases (KVKK Article 5)

• Booking requests, membership and listing operations: directly related to the establishment or performance of a contract (Article 5(2)(c)).
• Security and administrative records: the legitimate interest of the data controller, provided that it does not harm your fundamental rights and freedoms (Article 5(2)(f)).
• Meeting legal requests and keeping records: fulfilment of a legal obligation (Article 5(2)(ç)).
• In all other cases, your explicit consent (Article 5(1)).

5. Transfers

• Vehicle owners: your booking request (name, phone, email and request details) is passed to the owner of the listing you selected through the member panel and by email.
• Passengers: the owner’s short name and phone number are passed to the passenger who submitted the request; listing information is already public.
• Service providers (abroad): Cloudflare for hosting, database and photo storage; Resend for transactional email delivery; Google Fonts for fonts. The servers are located abroad; transfers abroad are made in accordance with the conditions set out in Article 9 of the KVKK (countries with adequate protection, appropriate safeguards, or the exceptions in Article 9(6)).
• Competent authorities: courts and public authorities in the case of a legal request.

6. Method of collection

Your data are collected electronically, by automated or partly automated means: directly to our server through the forms on the Site (booking request, registration, listing creation, account settings); by email through the contact and quote forms; and through server and session logs.

7. Retention periods

Booking requests for at most 12 months; membership data for as long as the account remains open (anonymised upon deletion); session records for at most 30 days; email delivery records for 90 days; listing view counters for 400 days; email correspondence for at most 2 years. Details are set out in the Privacy Policy.

8. Your rights (KVKK Article 11)

• To learn whether your personal data are processed and, if so, to request information about them.
• To learn the purpose of processing and whether the data are used in accordance with that purpose.
• To know the third parties to whom the data are transferred at home or abroad.
• To request correction if the data are incomplete or inaccurate and, where the conditions are met, their erasure or destruction.
• To request that correction, erasure and destruction operations be notified to the third parties to whom the data were transferred.
• To object to a result reached against you through analysis carried out exclusively by automated systems.
• To claim compensation if you suffer damage due to unlawful processing.

9. Applications

You may submit requests regarding your rights in writing to Limonluk Mah. 2453 Sokak, Ofis Çözümleri No: 3/C, Yenişehir / Mersin in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, or by email to info@bookgrup.com. Members can correct their name, phone and language details in the account settings and delete their account. Applications are concluded within 30 days at the latest.
